Reverend Magdalen Legal Fund

Rachel Bevilacqua (a.k.a. Reverend Mary Magdalen) lost custody of her son after a conservative custody judge was outraged at the fact that she is a member of the Church of the SubGenius. As a result of appearing in a adult-rated parody of Mel Gibson’s “The Passion of the Christ,” custody of her son was taken from her and awarded to the boy’s father (the couple was never married). Rachel and her husband have fought a long, expensive battle to win custody of their son, while her ex-boyfriend’s legal costs have been entirely been handled by a pro-bono lawyer (who is a friend of his). As of October 4, 2009, the case has been dismissed and custody of Reverend Magdalen’s son has been awarded to her. This appears to mean that after over three years of legal wrangling and over $100,000 in costs to her, Magdalen, her husband, and her ex-boyfriend are back to the status quo. That, plus she is still the only SubGenius officially banned from keeping SubGenius materials in her home, where her innocent son might accidentally come across them and become corrupted into the unholy, decadent lifestyle that got her into trouble in the first place.

Of the $6,700 raised from the pledgie.com pledgie.com donations page as of this time, $4,000 of this was back in March of 2007 when a desperate call for donations was made. At that time, Magdalen’s Dad had sacrificed his retirement savings to help with her legal costs, and the $4,000 raised at that time was intended to help pay him back for that. Since then, about $2,700 in further donations have been received – of which we are enormously grateful to everyone who donated. These donations have been used towards Magdalen’s legal costs…and since those legal costs ran up to about $140,000, every penny of this has been needed. Feel free to spread as many nasty rumors as you want, we don’t care. We are simply thankful to all of the kind souls who saw it in their hearts to help out.

I just read about all the legal troubles. That totally sucks. Why doesn’t the U.S. legal system attack creationists or holocaust denyers from having custody of their children? I have been an unofficial member in spirit of the Church of the SubGenius for 15 years, and, while generally being a misanthrope and asshole, I sometimes get the urge to help if I can. Here’s hoping for the full custody of your son and an end to this bullshit.

However, given your situation, I will always donate when I can. Why? Because the circumstances surrounding this case have created a First Amendment catastrophe of unimaginable proportions.


Unfortunately, the judicial punishment you received simply for expressing yourself is mirrored every day throughout this country in a variety of ways.


For example, in October, at Southwestern College (in Chula Vista, CA), the administration cracked down on students and instructors who were protesting class cuts, sending armed campus police to several faculty members’ homes afterwards and suspending them with pay, for allegedly “inciting a riot”.


This caught the attention of the ACLU and FIRE (Foundation for Individual Rights in Education); both organizations sent detailed letters to the college’s administrative officers threatening legal action and citing numerous Supreme Court rulings against such action.


Unfortunately, that was the eighth U.S. educational institution this year to have been admonished for attempting to clamp down on “the right of the people peaceably to assemble.”


Although circumstances on campus were different, the encroachment upon freedom of expression is similar to what you experienced while being interrogated at the Orleans County courthouse.


May you triumph over the little minds that generated this travesty of justice, and may your family members be forever free of such interference in their personal affairs.
